Terms & Conditions

1.Offer for Sale

Subject to the following terms and conditions, Seattle Tool Canada is pleased to offer for sale the tools, tool storage and equipment manufactured or marketed by Seattle Tool Canada (“Product’). Customer consents and represents that he/she is buying the Product for his/her personal use and not for resale. Placement of an order by the Customer constitutes his/her unconditional and unequivocal acceptance of the following terms which are subject to modification without prior written notice at any time and in Seattle tool Canada’s sole discretion.

2.Warranty

(1) For Customers buying the Product for personal use, they can acquire the Product warranty information by sending a written request to info@seattletool.ca. To enable the Information & Customer Service of Seattle Tool Canada to process as quickly as possible, please include a description of the Product in the written request.

(2) Except for certain types of the Product, Seattle Tool Canada warrants to Customers buying the Product for professional use to be free from defects in materials and workmanship for a lifetime duration. Settle Tool Canada will, at its option, repair or replace the Product which, after examination, is confirmed by Settle Tool Canada to be defective in materials or workmanship, or provide a refund with an amount equal to the purchase price of such Product. This warranty applies only to the original buyer and is not transferable. Seattle Tool Canada does not warrant any of its Product that is subject to abnormal use, including but not limited to misuse, accident, modification, unreasonable use, neglect, lack of maintenance or use after the Product is significantly worn. 3.Modification of Product Design

Seattle Tool Canada reserves the right to change the Product design at any time without incurring any obligation to incorporate such changes into the Product previously sold. Seattle Tool Canada also reserves the right to cease the manufacture or offering for sale of any Product at any time and in Seattle Tool Canada’s sole discretion.

4.Dimensions of Product

The product dimensions shown on this website have been rounded up to the nearest fractional size or nearest tenth millimeter and are not necessarily exact product specifications.

5.Transferal of Title; Risk of Loss

Title of the Product will be transferred from Seattle Tool Canada to the Customer upon shipment from a carrier designated by Seattle Tool Canada. Seattle Tool will be responsible for any loss or damages incurred during the shipment by the designated carrier. Seattle Tool may ship the Product in installments, if necessary. In case of Customer’s failure to receive the shipment within 14 days after billing to his/her credit card, the Customer must contact Seattle Tool Canada so that Seattle Tool Canada can begin to trace the shipment. Customers usually receive their shipments within 10 – 14 business days, however some shipments have been known to be delayed for longer periods for delivery.

6.Return of Product

Seattle Tool Canada offers a 90 days return on all Products purchased from this website. To return a Product, Customer is required to contact Seattle Tool Canada for the detailed instructions on the return process by: Via email – contact@seattletool.ca; or call at 1-888-858-TOOL(8665).

When returning the Product, it must be in new, sellable condition and received with all included parts and manuals. Please note that gift cards are NON-returnable/refundable. Customer’s credit card will be credited for the amount of the purchase price of the Product and the tax paid by Customer, less shipping charges for the return, upon Seattle Tool’s receipt and confirmation of the return. This refund policy, however, does not apply to the situations relating to shipment of wrong Product by Seattle Tool Canada or return of damaged or defective Product. If the Product shipped was not the Product ordered by the Customer, the Customer may choose to have the correct Product shipped. In case of a damaged or defective Product, the Customer may request for a replacement with an identical Product. Seattle Tool Canada requires that you return the purchased Product with prepaid insurance using Federal Express. Please bear in mind that Seattle Tool Canada is not liable for any lost or damaged returns, and that replacement or refund will not be issued without submission of a valid proof of return. 7.Delay of Shipment

Seattle Tool Canada shall not be held liable for any damages arising from any delay or failure to ship due to any cause beyond Seattle Tool Canada’s reasonable control, including but not limited to any act of God, act of Customer, regulations or request, embargo or other governmental acts, accident, fire, strike, slowdown, war, delay in transportation, or inability to acquire necessary labor, materials or manufacturing facilities. In case of any such delay or failure to ship, the shipping date shall be extended to the date when the reason for the delay or failure no longer exists. 7.Applicable Law

The terms and conditions stated above shall be governed by and construed according to the laws of Canada, without reference to principles of conflicts of laws.
